I acually counted out the days for 2009 just to get the exact number ... Mom getting 201 days Dad getting 164 so Mom has 34 more days than Dad does.
Due to holidays being split it will vary every other year, so I was kind of averaging it. However, that is still not a 50/50 split, so mom could still ask for child support. Also, even in a 50/50 situation the parent with the higher income generally ends up paying some child support.

What I am really trying to get you to understand is that whatever was agreed before is not necessarily fixed for the child's entire childhood.

Thanks for replying, my husbands lawyer has filed a motion to abate due to her not going through mediation we are currently waiting on what the courts decide. I will keep you updated,thanks again for everything! :)

Possesion during School Year

In the order is states word for word ....

Mother shall have possesion of the child each Monday thru Friday that the child is in school.While the child is in school Father shall have possesion of the child every weekend,beginning at 6pm on Friday and ending at 6pm on the following Sunday.


Does this mean that the days the child is out of school,for example teacher staff days and holidays like labor day.Does the father have possesion those days?

Hard to say if holidays and off days from school aren't specifically addressed.

My custody order breaks down all the holidays.

If your husband is going back to get this issue worked out, might be a good idea to specifically ask for holidays and non-school days to be put in there as well; that way there can be no confusion.
