What is the name of your state? NM
Can you sue a person for a personal debt not paid? What if that person has interests in the US but keeps his residence in Mexico? If there is a way to sue, should the person be sued here or in Mexico? There is proof of deposits of the borrowed money to his US Bank accounts.

Even if a person has money in US Banks, you'd still have problems suing them if they reside in another country and I'm not sure a 'long arm statute' would apply to out-of-country matters (it does apply to out-of-state). You'd also be subjected to the laws of their country, not ours, and may have to hire an attorney from that country (meaning you'd have to go to Mexico to sue). I would seek the advice of an attorney in NM, if you can get someone to speak with you for a few minutes as a courtesy to make sure of all this, but my guess is you're out of luck. Suing the bank won't do any good as they're not part of the agreement. Sorry.
