What is the name of your state? TNI
If an individual resigns from a job but has earned vacation time and per company policy will be paid for all unused vacation time at the end of employment but did not receive pay because the individual left before the time posted on the ledger. Ex: employed on Jan. 1, as of July 1st-6mths later, employee earns a wk of vacation, employee has earned the time but it will not show up until the end of the month. Employee resigns on July 5th and works out the month and receives last check as of the end of the month, but no vacation time is paid. Legally what recourse can the individual make?
 


geesh...you were SUPPOSE to take your vacation and THEN on the eve of return you e-mail that you resign...lol

Send a very strong letter that you insist on your vacation pay. Copy everyone over HIS head.

Under TN law unless the employer's policy or its collective bargaining agreement the employer is not obligated by law to payout acrrued and unused vacation to a terminated employee.

This is not legal information. Not only that, if the OP follows this advice, it could damage his/her career. There is nothing in the law that will prevent this employer from telling the OP's prospective employers that he/she sent them a "very strong letter" insisting on his/her vacation pay and copied this letter to all the company's leaders...somehow I suspect these prospective employers might decline to hire the OP after hearing this.
