I understand that he is an expert trained in this. To note, he couldn't have used his vehicle to pace me because he was parked on the side of the road. So he either used estimation or radar.

I only have to provide reasonable doubt, right? While he may be an expert, he is just human and humans make mistakes. Would the facts that there was dense fog and my car is light gray, almost the same color as the fog be enough to create reasonable doubt? That's assuming that he used estimation of course.

If he testifies that he used radar, I'll have to attack the accuracy/callibration/his training.

Let's address reasonable doubt.

We have a LEO stating that you were speeding. We have you stating that you were not.

He gets paid the same whether he stops you for speeding or not. He has no reason to say you were speeding if he doesn't believe you were.

You, on the other hand, have a very valid reason to say you weren't speeding even if you were.

So, when it comes to reasonable doubt, which one of you is it reasonable to doubt?

You missed my point. I'm sure he BELIEVES that I was speeding. But he's not God. He could have made a mistake, especially given the foggy conditions and color of my car.

So you're saying that if I can introduce testimony through cross examination that he could have possibly been mistaken about my speed because of the weather conditions, color of my car, and amount of traffic along that highway at 7:30 am on a weekday, that doesn't create reasonable doubt?

If that's your assertion, can you offer any advice on how I should go about creating reasonable doubt?

I think you're dreaming if you think the color of your car, regardless of the weather conditions, has any bearing on the situation.

I have been wrongly accused of a crime and I am seeking advice on how to handle it in court. Is that not the prupose of this forum?
