Actually I just spoke with a visitation mediator. Since there are no specifications, usually parents would meet halfway, or one picks up one brings back. She said that if he doesnt return him for school then he would be in contempt and possibly hinder any other visitation. It is just as much his responsiblity to get him home and it is for me to go and get him.

Umm just be aware that visitation mediators are NOT always law experts. Thier job is pretty much to get two parties to agree, so that they can get before the judge. And it doesn't matter what people agree to for it to get there in a lot of cases.. Only YOUR lawyer can advise you for sure.

halfway? wheres halfway? without stipulation in an order, is it the side of the highway? mcdonalds? where?....

Frankly as long as the kid is available to you to pick up, barring any provision in your order stating he must bring the kid to YOU, you don't have a case for contempt.

Up to a point its NOT his fault you can't afford to make two trips to get your kids...

Fully agree with haiku. About the mediator, about the dad not being responsible for mom's finances -- the whole thing.

ME TOO er I guess that would be three. The mediator is telling you what is common- not what is actionable.

Yep. And I have personal experience with a mediator who wouldn't know a family law if it smacked her across the face. :rolleyes:

Yes I agree with you guys also, but, it did work and now he is bringing him all the way back on the train by the time school starts. So, a victory on this one, however I will have the modification made as soon as the jurisdiction is transferred. Again thanks all for the help. Im all giddy with anticipation, I havent been away from my little guy this long before. It stinks. But on the other hand I am glad he got to experience his fathers place as well. :D

alls well that ends well- thank goodness he didn't do some of his own research.....now go get an order that is worth something
