please help, my 9 year old is being abused by teacher

What is the name of your state? NY please help me.my 9 year old daughter is being abused by her 3rd grade teacher, and his wife who is the librarian. it is not only my child, but several other students in her class. he pinches, pokes, and has even pulled the kids hair. i have been to the teacher,principal,superintendant, and the school board president(has not returned my calls). the school states they have a "no shuffling students to other classes"policy "no matter the circumstances". the principal agrees to the emotional abuse by both teachers, but not the physical abuse.he states that the marks were from the end of the day when the teacher walked britt to the bus, that she would pull away. the kids though, stated the abuse and marks happened during class lessons. there has been 6 students with marks and bruises. the school paid for a private substitute to teach my child during all of last week. however they wanted her back in this abusive class on monday, but i refused and pulled her out. my child is deathly terrified of this man.the superintendant called my work and threatened to turn me into dss, unless i signed an intent to homeschool paper by this tuesday, and stated that even if i did this, he would be closely monitoring my daughters home schooling and if i did one thing he didn't like, then he would turn me into social services for educational neglect. i have a legal tape recording that the school and i taped, of my daughters CSE meeting. in it the teacher makes many unprofessional comments, such as that he is concerned because next year is the 4th grade iowa reading and english tests... and that because of my daughter's poor writing mechanics, her grades would not only affect her, but her class and the school. as if my daughter would be the downfall of their precious school. really this school is so backwoods. many parents have been trying to get their children removed from this class and abuse, but no one will help us. there are also parents that have stated the abuse but are afraid to come forward, because when we do, our kids suffer worst. please help us. the cops and dss can't get involved due to it being school business. we do have proof, but no one cares about our kids or us.

Just curious... what do you expect us to do?? Your post says you have already exhausted all the 'normal' processes.... teacher, principal, board. Your next step should be to either put your child in private school, home school or talk with a local attorney or your state educational agency.

i have calls into the new york state education department, for atleast 2 weeks now, no one returns our calls. when you do call, all you get is an answering machine. i have pulled my daughter out and am homeschooling her. but i believe that it is my daughters right to get an education without abuse. i am a nurse, not a teacher. i try my best, but i know she could be better taught in school, as long as she is not in the abusers class. my hope is that someone will be able to tell me what the next step up is, since us parents are getting no wheres.

First and foremost, best of wishes and trust me, it might take time but it can be done.

I am not at all familiar with the school system in NY, but in general:

As far as I am concern, corporal punishment is not allowed in school any where in the US. It was in the past.

Teacher is not to have any physical contact with student. If he does, I am sure you could press charges against him.

The fact that the school principal does not seem to be very helpful, is not on your side.

I am assuming this is a public school. If so, the Regional Office, the School Board, or ultimately, the State Department of Education has to respond to the issues.

If I were you, I would not stop until the teacher gets fired.

Contact also, your representatives. We all pay taxes and they have to get involve on your behalf. Local Commissioners, state representatives, Mayor's office and so on.

When I was 12, and a new commer to the United States, my ESOL (English for Speakers of Other Languages) made some racial comments against me. It took a year, but he eventually got fired. It did help that I had the rest of the staff from the school on my side. But if I accomplished that at age 12, you surely will be able to accomplish whatever necessary.

You would be mistaken on this point. There are several states - mostly in the Bible Belt - that do permit corporal punishment.

mcedronron, it's really getting old reading your posts with such incorrect information and 'in my experience' crap that I've finally got to answer.

Yes, there are 100s of schools throughout the country that not only allow corporal punishment, but also require that parents sign a release during registration for such.

This is not legislated by the state but by each separate school board.

As for this poster's specific situation, Jet has given her the only advice that is possible on a forum such as this without a complete investigation and a copy of all paperwork the parents are required to sign in the registration process.

Your analogies do nothing but confuse the issue since you are in florida and NOT in each and ever state for which you post comments.

Buddy, ok, I was wrong, maybe I should had done a search looking for corporal punishment, and would had found out that in fact it is still legal in some states. If you notice, it is not in cities where people with a little sense live. I am sure it is legal where you come from. You were hit so many times, that your brain only allows you to try your best to put down people by calling them names and forget to try to help the poster. I am not here to take all this bs from you, therefore, whatever you say does not mean s**t to me.

If I replied to the post was to try my best to help the poster.

Anyhow, if you notice, the poster is in NY, and according to your own sources, it is illegal in NY. Therefore, I am technically correct.

The bottom line is, althought you have proven your point, as far as I am concern, corporal punishment should be illegal. I would not allow any stranger to lay a finger on my kids. That job should be left to parents. And even then, for the most part, hitting a kid, won't help. There are other kinds of punishment that work a lot better.

Besides, when you raise your kids the right way to begin with, which they obviously forgot to do with you, there is no need for any type of punishment. :D :D
