I had a neautral party serve custody papers on my ex wife yesterday. She assaulted that person. She then packed up her stuff(hers,herhusbands and her other son's) and adandoned our son with her mother. She told her mother to let me know that"I Win" and I can have him. She is moving to Indiana. The person she did assault filed a police report. What should I do? she also said to her mother that she will sign papers on Monday. What happens if she is in a different state already.

If she doesn't change her mind after she cools down. Then it looks like you are going to have custody of your son.

If she is in a different state already and doesn't come back for the hearing then you will win by default.

However, if you can have your attorney draw up an agreement for her to sign (with fair provisions for visitation, for your son's sake) that would be better.....or if you don't have an attorney, see if you can find a paralegal to help you draw them up.
