My former attorney was very disorganized and did a very sloppy job. For example, the list of exhibits attached to the Trial Readiness Report included a confidential communication between him and me, but omitted evidence of my economic damages. (I was able to remedy both of these problems before it was too late.)
In addition, he led the defendants to believe that he thought they had a very strong case, and then quit when I refused to settle. (The court ultimately awarded me approximately 24 times the highest settlement offer.)
His performance was so poor, I suspect that some of it was deliberate.
Would shortcomings of this nature constitute malpractice or an ethics violation?
