The TX marriage license requirements do not require information about prior divorce ...merely a t/f question under oath as to if one is married ...and a warning about lying ...not conclusive about prior marriage being properly ended .

You're going to need an attorney (there are going to be issues with the children most likely regardless of how you annul/divorce the spouse). If you have the dates that the supposed divorce took place, you can certainly send off your $5 or whatever they want to FloridaHealth to see if you can find the record.

Texas is not a state where a bigamous marriage is ab initio void anyhow, so you're going to have to pursue at least the annulment process. Your spouse will have to be served and then he can challenge if he actually had a divorce from the first marriage anyway.

Searched all of the areas he lived and can't find anything. I'm hoping the lawyer has better luck or is able to let me know if he is or isn't divorced from his previous wife.

Regardless. You want "out". So just assume you're married and go for divorce.

The issues, as far as you are concerned are mostly the same, regardless: division of assets, care of the children, and the man out of your life except what interactions are necessary as father of the children. Focus on that.

If he's really (knowingly) a bigamist, he'll let you know.

I agree with this advice. In the long run its generally going to be easier, cheaper and less time consuming.
