Son is 8 years old. The weights used is for dumb bells or barbells. He is ADHD and is on medication. Per son's pediatrician here in Tennessee the punishment is inappropriate for him. My ex has been reported to CPS but they did nothing.

There's a WORLD of difference between 'inappropriate' and 'abusive'.

stealth2-my ex was reported twice (which I should have mentioned in my reply before yours). The first was in December for the belt being used and they didn't do anything. The second was April 2005 for the stairs and they investigated it but then did nothing.

According to an article in Nashville Parent Magazine ( http://www.parentworld.com/news.ez?viewStory=1151&Form.sess_id=2062108&Form.sess_key=1126559378) ...

According to DCS, physical abuse is defined as “non-accidental physical trauma or injury inflicted by a parent or caregiver, and should not be confused with developmentally appropriate, discipline-related marks and bruises on the buttocks or legs of children over 5 when there is not past history of abuse or recent screened-out reports.” Physical abuse is considered a possibility when a child is allegedly struck on parts of the body in a way that could result in internal injuries

discipline-related marks and bruises on the buttocks or legs

I am sorry, but that to me is crazy, yes an open handed spanking may leave a little tushie red for a short period of time, but to leave bruises?! what are other "related marks"? scars?!

Yeah, I'm not sure my state's laws are any better though...

MISSOURI

Discipline including spanking, administered in a reasonable manner, is not abuse. Sec. 210.110. [Ci.] Force justified if by parent/guardian/other person with care and supervision of minor if- -- Person believes force necessary to promote welfare of minor, and -- Force used is not designed to cause or believed to create a substantial risk of causing death, serious physical injury, disfigurement, extreme pain, or extreme emotional distress. Sec. 563.061.[Cr.]

Could be why it always seems like CPS 'does nothing'.

It is weird though, because I always thought that in my state, anything other than an open handed swat on the butt (while the butt was covered with clothing) was against the law. Apparently, it's all kinds of legal to beat the crap out of kids as long as you're careful not to damage their organs.

or at least if it is not your intent to hurt their organs, or if you don't believe it will hurt their organs
