According to DCS, physical abuse is defined as “non-accidental physical trauma or injury inflicted by a parent or caregiver, and should not be confused with developmentally appropriate, discipline-related marks and bruises on the buttocks or legs of children over 5 when there is not past history of abuse or recent screened-out reports.” Physical abuse is considered a possibility when a child is allegedly struck on parts of the body in a way that could result in internal injuries
Yeah, I'm not sure my state's laws are any better though...WANNACRY said:discipline-related marks and bruises on the buttocks or legs
I am sorry, but that to me is crazy, yes an open handed spanking may leave a little tushie red for a short period of time, but to leave bruises?! what are other "related marks"? scars?!
MISSOURI
Discipline including spanking, administered in a reasonable manner, is not abuse. Sec. 210.110. [Ci.] Force justified if by parent/guardian/other person with care and supervision of minor if- -- Person believes force necessary to promote welfare of minor, and -- Force used is not designed to cause or believed to create a substantial risk of causing death, serious physical injury, disfigurement, extreme pain, or extreme emotional distress. Sec. 563.061.[Cr.]
Could be why it always seems like CPS 'does nothing'.WANNACRY said:yeah that is a lot of gray area there

It is weird though, because I always thought that in my state, anything other than an open handed swat on the butt (while the butt was covered with clothing) was against the law. Apparently, it's all kinds of legal to beat the crap out of kids as long as you're careful not to damage their organs.
