OKAY SO I NEED INFO, ME AND KIDS FATHER WAS ON OUR WAY TO WORK WHEN WE GOT PULLED OVER IN OUR NEIGHBORHOOD, WHEN THE POLICE CAME TO THE DOOR THEY ASKED MY BF TO STEP OUT, WHEN HE DID THEY TOLD THEM THEY HAD A SEARCH WARRANT TO SEARCH OUR PROPERTY TO TURN THE CAR AROUND AND MEET THEM AT MY HOUSE, MY BF STEADILLY ASKED TO SEE A WARRANT AND THEY KEPT TELLING HIM THEY WOULD SHOW IT TO ME WHEN THEY GOT THERE, WHEN ARRIVING AT MY HOUSE THERE WERE 6 POLICE VEHICLES IN MY DRIVEWAY ALREADY WALKING AROUND MY PROPERTY WITHOUT PERMISSION OR LETTING ME SEE ANYTHING, THEY KEPT MY BF IN THE BACK OF THE POLICE TRUCK HANDCUFFED THE WHOLE TIME, THEY WERE SEARCHING FOR MARIJUANA PLANTS WHICH WERE THERE BUT OUTSIDE OF THE HOME, NOTHING WAS FOUND INSIDE. THEY TOOK MY PHONE AND HIS, HAD ME AND MY KIDS OUTSIDE FOR 3-4 HOURS IN THE HOT SUN DURING THIS RAID IN WHICH THEY FOUND NOTHING BUT 5 PERSONAL VERY SMALL PLANTS, NO BUDS JUST BABIES. THEY INTERIGATED ME THE ENTIRE TIME ASKING WHERE IS THE MONEY, DRUGS AND GUNS, I HAD NO IDEA WHAT THEY WANTED .. ALL WE HAD WAS MY BF PLANTS, THEY THEN TRY TO TELL ME THEY HAVE BEEN WATCHING US AND HAVE EVIDENCE WE SELL MARIJUANA, IMMEDIATELY I KNOW ITS BS, THEY ARREST MY BF, CALL DFACS TO COME AND GET MY KIDS AND THE CONDITION THE POLICE LEFT MY HOUSE IN AND THESES ALLEGATIONS OF THE MARIJUANA GOT MY CHILDREN TOOK FOR NINE MONTHS, WHILE DFACS IS AT MY HOME THEY COME BACK TO ARREST ME, OWNERSHIP HAD ALREADY BEEN TAKING FOR THE PLANTS AND NO DRUGS OR MONEY WAS FOUND DURING THE SEARCH I WAS COMPLETLY COOPERATIVE WITH AUTHORITES. WHILE MY BF IS IN JAIL THEY SHOW HIM WHAT IS TO BE EVIDENCE OF HIS SELL, TURNS OUT IT WAS THE SAME INDIVIDUAL (CLOSE FRIEND) WHO CAME TO US TWICE LOOKING FOR SOME HELP FINDING SMOKE, IT WAS THE ONLY PERSON WE EVER HELPED WITH AND MADE NO PROFIT WHAT SO EVER WITH, THIS PERSON SET US UP. OKAY SO MY QUESTION IS THIS, IT HAS BEEN 9 MONTHS, MY KIDS HAVE CAME HOME AND I STILL HAVE NOT HEARD ANYTHING ABOUT A COURT DATE, NOTHING NO INFO! THE ONLY THING I HAVE FROM THEM IS A AFFIDAVIT/APPLICATION FOR A SEARCH WARRANT .. NO ADDRESS ISSUED ... NO NAME ... BUT SIGHNED BY A JUDGE, THEY ARE TRYING TO PAINT A PIC OF SOMETHING WE ARE NOT, I HAVE SUFFERED TERIBLLY .. I FOUGHT LIKE HELL TO BRING MY KIDS HOME .. COMPLETED A DRUG TREATMENT AND OTHER CLASSES AND I FEEL LIKE IT WAS WRONG. WHAT CAN I DO? WE ARE NOT DRUG DEALERS, AND WE DO NOT DESERVE THESE FELONY CHARGES AS THEY MAY RUIN US. FINACIALLY I CANNOT AFFORD A LAWYER AND I FEEL AS IF A PUBLIC DEFFENDER WILL NOT FIGHT FOR US. ANY ADVISE IS HELPFUL!!

Well, if you can’t afford an attorney and don’t want a public defender, you had best brush up on court rules and start working towards defending yourself.


Have either if you actually been charged with anything?

Yes, you do. Possession of ANY marijuana in Georgia is a felony. "Helping" your friend with some may add distribution/sale to the charges.

My guess is your druggie friend got picked up on his own charges and ratted you out for a lighter sentence or he was a CI in the first place.

Don't do the crime if you can't do the time.

Not true. Possession for personal use of an ounce or less is a misdemeanor. (OCGA 16-13-2). The statute is a bit convoluted.

Any amount for sale, distribution, or cultivation is indeed a felony.
