The responsibilty to prove payments have been made is on that of the payor. It's in your best interest to keep track, however should there be a question, she must prove that a payment is made. The best way to cover both of yourselves is to have payments made through the Family Support Registry in your state (if your state has one.) I forward my ex a receipt the day I get her electronic child support payment. She has indicated that she does not want the receipt because it shows a deduction on her payroll check. There is no wage assignment ordered so I use the receipt via e-mail as documentation as to monies paid as well as monies in arrears.
question: Should I continue this practice (legally) for future court action for failing to adhere to settlement agreement when pertaining to the child support payments? I used e-mail to provide an electronic means of accountability. Is this correct or is there a better Legal way to conduct this matter?
