Myself and my attorney believe we can certainly prove malicious intent. it's an attoerney I've been with for several years so I do not beleive he is misleading me just to make money.
Good for him.

As I said, laws are different in each state. Yours may have a lower threshold than mine, and the case may be stronger when you have all the facts than when you outline them on a web forum. Hence the reason even attorneys are not going to provide formal legal advice on line.
