What is the name of your state (only U.S. law)? Rhode Island

My tenant was month to month tenancy with rent due on the 1st for the current month. Tenant gave 30 day termination notice on the 15th and moved on the 15th of the following month. My question, Is tenant responsible for rent for 15 days or 30 days of that month? Doesn't month to month imply an entire month?

Yes it does. So did you keep the deposit for the portion of rent he didn't pay?

Month to month with a written lease or month to month oral agreement with nothing written ? If nothing was written down then your states law minimum notice to give by LL or tenant to the other is what would be proper notice. ( so if you had a written on paper lease and that lease called for say one whole rental period of notice then tenant notice is not proper notice tenant payment thru the 15th would be short. If your state law says 30 day notice when there is no written lease then only then there should be no reason that a tenant cannot give a 30 day anytime notice and prorate the amount paid as well )

Thank you. I do have a written lease which automatically became a month to month lease at the expiration of the original term. I don't have the lease in front of me but will check it for the notice requirements. Thanks again.
