What is the name of your state? Ohio. This is to respond to ALawyer's help in regard to my trust question about it being 'redrawn'. I wasn't clear enough (as someone at home reminded me) but in the original trust my father gave my stepmother power to revoke the trust as written at any time and do as she pleased with the provisions therein. As it was in such a mess (the trust was completed but the assets were not all transferred before he died) she had her lawyers rewrite it, transfer the rest of the funds and stated to me that it was re-established per my father's original documented wishes (the only copy which I still have). Since she has not given me a copy of the new trust this is why I asked whether I have a right to obtain it legally if I am supposedly still listed as an heir therein. I realize she could long ago have excluded me entirely but if so I need to see it in writing to let this go. If I have a legal right to get a document to see what she has done with the money, I need to go through such channels to do so to end this.

Assets NOT in the trust would have been part of his esate and you would have been entitled to a share of them, assuming they exceeded his state's marital share.

If she had power to end the trust and get everything, she could easily cut you out completely. Or she could use up the money during her lifetime.
