No, I did not know this was a fly-by-nite company I was dealing with. I ASSUMED that since they were advertising weekly in the local newspaper along with passing out business cards that they might have a clue at to what they were doing.
then that is your fault. You should check this type of thing. Anybody can run an add in the paper and business cards? I am pretty sure those printing companies do not check out the purchasers info.

I guess I should be running background checks, employment history, criminal history and blood type on the individuals I choose to work for me. It is much easier to give someone the benefit of doubt.
the I guess you will continue to live with the results of your inactions. Don't cry when you get burned then. Obviously you were being facetious with the list of checks but a prudent action would be to check references, licensing, and insurance for any contractor you hire. This guy was actually in a position to sue you for everything you own should he have been injured on your property, from what you have said. Not a smart move on your part.

I may not prevail in this case, but they don't have any of my money yet!!
true, but the do have a legal action against you. I have not checked the criminal statutes but you may have committed a crime in your actions.

And, it is not like I can loose any more than they say I owe ($788.16) which I can prove that amount should be less than $500.00
Oh really? How do you claim this? If your contract was for the 788, then that is what you would owe. Haven't checked but you may owe attorneys fees as well on top of that.

However, therefore and whatnot, from what I've read and been told then I welcome their suit. IF, they have a leg to stand on it is a broken leg, we will see I guess if his cousin, his attorney has any gonads.
he may have gonads and he may also end up with your money because of your failure to act properly.

It is just like I said before, if you're the defendant here then it is automatically assumed that your are in the wrong and must be guilty, therefore you must pay or go to jail or whatever the case may be.
Nobody said that. I just pointed out that your action of stopping payment on a check was the wrong thing to do. You are the one that has the "you all blame me" attitude. I never said a word about your actual claim.

I was the one who got screwed over, but since I'll be the defendant I must be guilty.
Well, if you say so. With that attitude, at least you won't be upset if you do lose.

And, I will take your advise not to take your advise.
that's your choice. I couldn't really care less.

and btw; advice is a noun; advise is a verb. In my sig line, advice is properly used as the noun.

Thanks for pointing out my error between advice and advise. It was a typing error I guess. Might of just been my stupidity. Regardless, I am sure that it just made your day to correct me on that point.
