A good attorney will only represent one person at a time. If this attorney insists on representing the whole flock, then y'all need to put in the attorney's contract what happens if squibblings appear.

Thank you BlondiePB and seniorjudge. We held out hope for a response from the trustee for family's sake--nothing so far. We wondered about separate attorneys, but were encouraged to stick together as a show of force. Do you think this is wrong? We are very close and have got along our whole lives. As far as the attorney's fee--he pointed out that with a contingency fee, he is paid only if he wins the case. But if we pay him hourly, he gets paid win or lose. He told us this could take a long time to resolve, with no guarantee of winning. We are trying to make the right decisions, and really appreciate all your help.

How long this will take all depends on the trustee. When a trustee is not forthcoming, that is a sign of fiduciary abuse. Unfortunately, money does cause rifts - even when there is no fiduciary abuse.

You are very welcome for the help. I will still refrain from telling what type of fee schedule to do. I will tell you to listen to that "voice inside" you. That is divine guidance that is not to be ignored.
