I've retained a real estate attorney and he seems pretty confident about winning this case. The first question he asked upon reading both my deed and the easement was "what's wrong with this guy?" I have all the necessary paper work plus the time and date of it being drawn up and recorded. He thinks like I do, that he did it the way he did to try to hide its existence from me. Deed and easement were done on the same day by two different lawyers two hours apart. I'll update the judge's decision when it's over. Once again I want to thank all who have assisted me here. Well, that sounds like he might need the easement to access an existing home? Is that correct? If that is true then that could explain why the sheriff is unwilling to stop him.
the home that the easement goes to was started in 2012 and is currently unfinished.
