You're not trying to put foolish ideas in Mom's head are you?
No, just the opposite. I'm trying to present all aspects of the situation. I think it would be a monumentally stupid idea for mom to move out of state with the kids...vacationing is just fine. And I'm not talking "Oh we're going on a 2 year vacation." No, I mean heading to another state for a week or two of sight-seeing, or something along those lines.

How much distance are we talking about?

And what is your plan to support yourself and the children after you move out? Staying with mom and letting her support you will work for a little while, but not forever.

I am the primary caregiver and a stay-at-home mom to my two children. I want to divorce my husband (who is a non-US citizen). He threatened to call the police if I take our children over state lines on a vacation in another state that he was already aware of. Does he have a leg to stand on?
No he does not have a leg to stand on..at all. The police cannot and will not do anything for him.

In addition, when I leave him, I want to move back in with my mother in NJ where my family support system is located. Can he legally keep me or the children in Maryland? I feel that the children should be with me and since I am a stay-at-home mom, I don't have the income to move to another house in MD with or without the children. My mother is willing to let the children and I live with her.
If he rushes to court and asks the judge to order that the children be returned to MD, pending to the outcome of the case, he does have a decent shot at that. How far apart will you actually be if you move to NJ?
