What is the name of your state (only U.S. law)? TX

My 90+ year old parents had some minimal roof damage in a hailstorm (metal roof). The insurance company paid the claim. My parents had unexpected health problems come up and had to use that money for medical reasons. Now they have been told they have to have a $15,000 composite roof put on by May 1 or they can no longer get insurance on the house. The roof does not leak. They honestly believed they had until they sold the house in about a year to fix it. They do not have the money and we don't either. Will another insurance company insure the house? Do they have any options? Help please.

The damage to the roof from hail is probably not the issue here. the insurance CO wants you to have a composite roof for whatever reason. They can't force you, legally, to make the repair, but they can non-renew the policy. check out foremost.com. they will insure ANYTHING.

Foremost can and will deny new policies and existing damage to the roof is a specific reason for them to deny new business coverage.

they dont have to fix it at all.

Your parents were paid for there damages if they elect not to do them then thats there choice. They have up to 1 year to make repairs or insurance co has right to refuse futher insurance. When selling house you dont have to disclose hail damage there home inspector should catch this. But ethically you should tell new homeowners before selling house to them. Also if there is a mortage on house which i doubt there is cause check would have came in mortage co name and parents. But if was the mortage company would keep money and put it on mortage and value house at x amount dollars less. As far as forcing u to put roof on, "no," as far as not insuring anymore unless u fix roof only fair cant pay twice thats bull. put house in kids name call differant insurance co say just bought house come and insure it. Bet they dont catch the hail damage if do no harm done. Call another one. But no they do not have to fix it its there money

I would love to respond to the last post but since it wasn't really written in English it's hard for me to understand what you're trying to say. Thanks.

This is what Im trying to say

They dont have to fix roof, but if they want to stay with insuree they need to fix it. If they wanna take a chance and call another insurer they can odds are 50 50 insuree would catch hail damage. Or sell house and just value it at less for roof damage. But you can also buy insurance which wouldnt cover roof. They have many choices. Insurance may not be as good but least they will be insureed. If house is paid off take out mortage for roof use house as collateral. Is that better english

**A: I disagree. The insurance money was to fix the roof.

It is irresponsible to advise others to commit insurance fraud.

one of you is right

Yes money was for roof but unexpected bills arose and now its gone. It is their money and they can do as they please with it. Yes they were paid for their damages. Now it's their choice to fix or not. I'll agree should have fixed roof but didnt so here we are now. They now have a problem. And the choices I gave them are sound. May be sneaky but using money was too. Anybody paid by insurance companies for their damages can use that money any way they see fit. Maybe you two should brush up on your facts before replying. There is no ethics here to follow. You are paying for insurance use that money for whatever you deem neccesary. But I would like to stress you should fix stuff when paid for. Thus it opens two cans of worms, one next time you call insurance co for claim lookout they got file said you spent money next claim wont be as easy. Two now you have a damaged roof and no way to repair it. Good luck

You have twice suggested that intentional non-disclosure is somehow "ok". Furthermore, one of the non-disclosures that you suggested could turn in to a felony.

Please stop posting.

What insurance company is going to knowingly insure this house with a damaged roof? One of the first questions an agent should ask is if the damages have been repaired. That's for a standard company. For a non-standard company the application will ask if the damages have been repaired. Are you suggesting they they lie on the application? If not, back to the original question. What insurance company will write this policy?
