First, thanks to broad007 for saying what I was getting ready to say!!!!

Now, in response to the rest:

At the time that the counselor suggested living with my husband, his soon to be ex wife was in jail for failure to pay restitution on insufficient funds checks and failure to appear on traffic tickets. - Just because the counselor recommended it, the court was not mandated to follow this. Though they gave him temporary custody, his ex then tried claiming abuse in the past. The courts decided at that time that "in the best interest of the child" he did not need to be seperated from his half sister.

The only heat in the four bedroom house is one fireplace, to which they have rigged box fans up as to "move heat through the home". - This is me whining??? I thought it was legitimate!! If for nothing else, concerns of carbon monoxide being possibly emitted throughout the house. The home DOES have a heater, but CP and her husband have told children they "can't afford it." (Yet they can afford firewood......anyway......)

You say that police have been to mom's home, after your call to them and they found nothing wrong, yet you accuse mom of having so many animals that the house smells from outside. Sounds like bs to me. - Sheriff deputies actually have the smell documented from that visit, along with other problems with cleanliness in the household.

Mom has tried to commit suicide and dad does nothing. -Dad DID DO SOMETHING!!! Police and psychiatrists were involved, she was released from hospital within 24 hours without even the normal mandatory after visits with a counselor!!

Daughter is getting into sex toys and sex abuse allegations circulating, dad does nothing. - Dad, again, DID do something, but at the time, "not enough evidence to prove allegations at this time, case will remain open, pending further invesigation". As I said, caseworkers in the area are SEVERELY overworked. Something along the lines of one worker for every 200+ cases. 2 1/2 years later and the case is still open pending further investigations.

But now that the child is crying on the phone. - I'm sorry if you think this is no big deal. However, for a child that is normally very happy and upbeat to go to being terrified of his mother and stepfather, I happen to see that as a big sign that something has gone drastically wrong!

Now, for those of you who have offered some legitimate advice, I do thank you! I was just wanting to know what, if any of this, may or may not help, so that we could get it all together before going to a lawyer!
