I am going to closing on Tuesday, no problem with this except that I think my realitor is trying to pull a fast one on me..let me explain. In Janurary I was called to active duty, and I decided to let my realitor rent my home while I am away, well I signed a contract with my realitor for some folks to rent my place to them for 6 month's, well after a month the realitor found them something else (let them out of the 6 month contractwithout my knowledge) so they were only in my home for about a month, then they bounced the rent check which in turn all of my checks bounced, and I told my realitor about my bank fees that I now had to pay and she just ignored me. I brought my home for 163 in 2001 and know im selling it for 207, the realitor is getting 6% off the top from the sale and now she told me that I should give her a 2,000 dollor bonus for getting more money for the house , initially she was going for only 195 (but isnt this her job), Is this normal? :confused:

*** Of course it isn't. Simply, pay the realtor ONLY what is required in the listing agreement. There is no obligation for you to pay a penny more.

Then, after you pay them, go down to your local small claims court (max $2500) and file a claim listing the realtor AND the former tenant for the 'damages' you incurred due to the bounced check and the agents breach of contract.

You might just get a chunk of your commision money back.

Thanks for your reply Jetx, but since im on active duty I really don't have the time to go to small claims court to file for the small stuff, I just want this to be over and done with but she aint gonna git 2g's from me....also The house had to be repainted and she took the thousand dollars from escrol that the renters gave to her and paid for it , now she says I owe her that too...(whiskey - Tango - Foxtrot- Over)! I rented my home for 1600.00 and i asked her what happened to the 600.00 and she said that that was her fee, but for what I have no Idea!..I'm talking to my Jag officers now about this...I really feel like im being taken advantage of

*** I agree. I would DEMAND that this agent:
1) Provide a DETAILED statement of account, for all funds received either in rental or the sale.
2) DEMAND copies of all receipts for expenses paid from those funds.
3) DEMAND copies of any signed documents where you authorized those deductions.

Then, if she refuses or fails to provide.... an M-18A1 would be appropriate!!

In addition, send a complaint letter to the agent's principal broker and the MD state real estate licensing agency.

Be sure to send the letter via certifed rrr mail. Many times carrier pigeons do not bring back receipts of delivery.
