She also better be able to prove that she can not get cash in any manner in order to aid her refinance. And she better not have bought a new vehicle or other luxuries (vacation for instance) in the time that she states she cannot refinance.

Oh I will save you the trouble -- OP contact an attorney in your area to talk to because LD was disagreed with.
How many recently divorced people could possibly come up with cash to aid a refinance? I am sure that there are some, but the vast majority of people could not.

The point I am making is that the house is upside down, she has already explained that she has no cash to bring to a closing, and the ex filing for contempt could end up with a result that would do him MORE credit damage than the fact that she has not yet refinanced him off the loan.

If I had a choice, I would rather have my credit tied up than live with the ding of a short sale on my credit report.

Thank you for the replys... I have contacted my divorce attorney but she hasn't called back. I did receive two letters from his lawyer via mine in the past and she communicated the status each time.
I can see both sides of this issue and I am trying to gain equity by paying extra each month toward the principle. I've been doing that since we separated in 06.
