shoplifting?

No, the security guards (LPO )did not ask me anything. Yes I had money, I also had purchased some items from automotive depart. I had not left the store yet nor did I attempt to leave the store. A police officer approched me. He asked me if I had some things I had not paid for and I turned them over to him. I told him I had not finished shopping and intended to pay for the items. That is when LPO told me it was to late, I was then taken to the break room where they went through the rest of my bags. Another thing I learned was I had been running a total of the items in my head, when LPO added the items I disputed it, I was then in formed that the sale price is not what they go by, but the retail price. I wasn't arrested, I was issued a citation. Its not uncommon to shop in a mall with several different bags from several different stores. When I left the first store and went into another store, I had no problem. This was the third store. Since my story is so hard for everyone to believe, are you sugesting I lie? And say what?

oh OK, I'll stop. I guess its awful easy for you all to be rude and judgemental sitting behind your computer screen. I just wanted some sound advice. I can see its not going to come from here. Thanks again, and now you can move on to your next victim.

I shop in many stores during a day, but things don't find their way in to other bags either. THAT is what is so hard to believe...that these items "worked" their way in to your other bags...that doesn't make sense at all.

As another posted said, I too worked retail, and it was ALWAYS that the security officers had to wait until you walked outside with the items before they could approach you about shoplifting.

I think there is something missing to your story.

What you spent prior to the unfortunate behavior of the items that began clinging to you doesn't matter.
It can make a difference if you still had money in your purse when you were stopped by security, as not having any money then could have your actions seen as a pre-meditated. No one goes into a store to buy merchandise with no money on them. So, did the security check to see if you were financially able to pay for the goods when you simply forgot to do so? If not, that doesn't add any credibility to your already unbelievable rendition of what occurred.

Have you ever heard of a "Debit" card?************** A "Visa" card?...A "Master Card?......

Better yet, your "Debit/Credit" card, that we all carry in this year of 2005?

HUH? You stated you were shopping at the mall. What mall has a automotive department?, unless you purchased oil from the tire center of Sears.

Seriously, you need to stop posting. The guard in the store would have escorted you to the cashier, to pay for "ALL" the items.

YOU were detained inside the store for a reason.

Yes, a credit card/debit card, would show you were financially able to pay. As would cashier checks, money orders, check book, store gift cards/gift certificate, credit slip and even "gulp" cash! Yes cash is still accepted in 2005! (Gold dust isn't near as popular these days) Seeing how the poster mentioned saving up for this big shopping(lifting) day and had already spent $300.00 I assumed she was using cash. However, "Financially able to pay" doesn't limit that ability to cash. (although it may in this case)

Apparently they had reason to believe you did this intentionally. As you will note you are having a hard time convincing anybody here that you did not do this intentionally as well. Not sure...has there been 12 posters...there's your jury.

If you want sound advice..go to a stereo store :D ....here you got legal advice and opinion. While nothing is impossible it doesn't look good for your situation. Hopefully you can find a good lawyer that can help you. Good luck.

It is best to wait until someone passes the registers, but is not required. Stuffing clothing into a bag can be sufficient to supply intent.

Ultimately it is up to a court to decide.
