OP, check around locally and specifically for your state.

In Texas, most complexes are part of the Texas Apt Association, and when renting an apartment, once the child is over 2 yrs old, you are required to rent a unit that would give an extra room for the child or children to share.

Your state/area may have something similar to TAA.

HOWEVER..... this doesn't mean that the child will be required to sleep in that extra room, you are just required to have it available for them.

AND, if OP takes this to court, s/he just might be ordered to pay more $$$ to take care of that troublesome lack of sleeping space. ;) :p

There isn't such a provision in the statutes. In Section 8 there is requirement for children to have a room...and some complexes have that requirements..But in terms of "THE LAW" there is no such thing...

There honestly might be occupancy requirements/laws under landlord tenant law....but that has absolutely nothing to do with family law or child custody.

No...There isn't. Unless the Apt is Section 8 or otherwise subsidized...but those are their own policy/guidelines, not a law.

Our kiddo, who did have her own beautiful room and dreamy sheets, duvets, and down comforters, STILL preferred to sleep with us until she was past six. NOT illegal at all.
 
My daughter is nearly 15 and STILL chooses to sleep with her mommy half the time. Despite having her own "palace"....she likes my big bed better!
 
I worked in the apt industry in Texas years ago, but I believe I recently learned from friends still in the industry that Texas fair housing laws only allow apartment landlords to limit the number of PEOPLE that can occupy a dwelling on their properties.....such as a one bedroom being limited to 2-3 people, requiring a family of four to lease at least a 2 bedroom apartment. They cannot, however, discriminate on the basis of gender, age or ethnicity.

The TAA is a private coalition of landlords and tenant advocates, not a government agency. A property owner is not required to use their forms.

I am so glad to hear this because Stink still prefers sleeping with me despite the preteen bachelor pad he has in his room.... he'll be 12 in 3 weeks.:eek:

Heh. The girls sleep in their room almost all of the time... that is, afterall, the only place they're allowed to watch Hannah Montana :rolleyes:.

But they generally sleep either together on Wild's bed or Unruly sleeps on the floor. I think the top bunk is reserved for dolls, stuffed animals and extra blankets.

But then, I'm one of those terrible parents who forces all THREE KIDS (of differing genders, not less) to share a room.

Stink was the first between the 2 of us to get a flat screen TV. His TV broke, and his replacement was a flat screen (courtesy of grandma CC). CC has outfitted the room with a DVD, stereo system, PS2 AND X-Box, bunk beds for 1 kid, NFL licensed bed sheets and all the cute little NFL decorations to go with it and bean bag chairs to sit and play with all the zoom zooms and wham whams.

His friends come over... they spend all day in the room. When it's time to go to bed, he comes in mine... I don't get it. I almost want to live in his room. But I have the computer :D
 
Alas....when my daughter's cheap laptop broke, my laptop started residing in her room.....and I usually just use it now when she's asleep, in school, doing her homework or grounded.

My daughter's 15th BD is in March....and she STILL watches Hannah Montana!
