What is the name of your state? New York

My brother bought a car from a used car dealer and recently found out the car has been recalled and wasnt fixed before the sale. What should he do? :confused:
 


I can't speak of the legal issues..

but has he brought it to a dealership and had the recall fixed? If it is a factory recall, it won't cost him anything.

yes, he is taking it to be fixed, but I would like to know if It's legal for a dealership to sell a car that has a recall.
 
Like I said, I certainly can't answer legal questions..

but I've never heard anyone complain about that. I worked in a dealership for two years and the new cars with recalls were always fixed before being sold. But I never remember any of the used cars being sent off to fix recalls. Whether that's legal or not, I can't say.

Many used cars get sold without the recall being done. How would you expect used car dealerships to know about every recall? Even places like CarFAX does not list the recalls for all vehicles. Being that a recall is FREE to the owner or the selling dealer, what are you complaining about? When buying a used car, Caveat Emptor (Buyer beware) - meaning it is your responsibility to check out the car. The NHTSA lists all the recalls for all cars. Within 2 minutes you could have had this info. So again, I ask, what are you complaining for?

Well, Thank you for your input but I dont consider this complaining. I'm just simply asking is it legal for what happened.

complain :
1. To express feelings of pain, dissatisfaction, or resentment.
2. To make a formal accusation or bring a formal charge.


Inquiring/complaining - what does it matter...

There is a website where you can list your VIN#, and it will do a search as to whether there was a recall fro your make nad model... Do a search in Google for recalls, and you should be able to find it... Most people don't know there have been several recalls for their vehicles... A recall does not cost you any money to do as it is free, this includes the new owner of the vehicle...

I'm not aware of any place on the Internet where you can put in a VIN number to check for recalls, but the best place I would suggest is to go right to the horses mouth. The NHTSA (National Highway Traffic Safety Administration). You put in your make model year, etc. and they will tell you if your car is recalled. They will also tell you about defect investigations and consumer complaints for your vehicle. Make sure you take the defect investigations and consumer complaints with a grain of salt, as they don't mean too much until they become recall status.

In New York, recalls must be completed on a new vehicle sale by a dealer , but used vehicle sales do not require it unless it is a safety issue.
Go to " MY Car.COM" and you can get a list of all recalls that are open on your vehicle.
