Yeah he signed it and i presented it before the judge,she denied it.

No problem Sticky...I was just wondering why I was being jumped on. Thought that maybe I had made a response during one of by "b*tch" days LOL. OP, from the information that I have been able to find out for you, you will have to pay for another filing. Your original filing was denied for specific reasons. If you want to resubmit, there is another court fee and yes, I know that it is steep.

This is for anyone filing in NY state, learn from this OP's mistake. By coming on this board and googling I learned a lot BEFORE my petition was filed. It pays to be informed. Every state has different laws/grounds, etc. NY can be tough. If this poster had done some research (and I am NOT downing you for not doing it - I know it can be hard when you are emotional) she would not have been in this predicament. So, you will have to refile under Cruel and Inhumane. It would be a good thing for you to get a consult with a local attorney. There are many that do consults for free. Call several and go in and have a chat. Good luck to you.

PS. I couldnt find this info on any of the websites but asked my old attorney about it today - just out of curiosity.

Many if not all areas have Lawyer Referral Services in the phone book . 1/2 hr. for about 40 bucks . They set you up with the kind of Attorney you need .

I myself entered just about All the numbers for the reasons for Divorce , 2/4/and 1 , and as I said the Judge picked one . The one I could prove , I guess . # 2 .

I had no idea that you could actually do that! Interesting. Also, I agree with the Lawyer Referal Number. It is very helpful. Also, the local bar associations are great help. There are many resources available in this state to help people become informed.
