Almost There writes - I am not seeing that. OP is upset that the STBX wants every account to be included in the assets. Even the smaller ones. Nowhere does OP say 50/50 beyond the cars. OP does state a desire to screw over the STBX as much as possible.

Okay.. I missed that, and OP did say 50.50. Still, OPs desire to keep some account out of the mix does not read 50/50.

For goodness sakes. Get an independent third party appraisal and make for an equalization payment of assets. IE., as OP describes her car is worth $8k, his is worth $4k. Difference is $4k and split is $2k each. OP's ex should equalize a payment as such along with other asset values. Simple.

This post pretty much tells how I am feeling. I was not (notice the past tense please) out to screw my stbx in way shape or form. My suggestion was to put every asset on the table and share it 50-50. I was not planning to go after accounts with few dollars in them. We both have such accounts and I know. But now, everything is a fair game as the opposing counsel's settlement proposal showed. So, I am going through every piece of discovery document sent by the opposing side and noting down everything that I may have a claim on, requesting what looks like, the document's deliberately left out (such as missing bank statements in the middle of a series of them). It is at least going to be an interesting settlement conference, if nothing else.

Quick question

I have a quick question.

While I was going through the bank statements, I noticed, in the 6 months or so, prior to my stbx filing for divorce, there is a significant amount of cash withdrawals from the personal accounts. Since I was caught like a deer in headlights to this divorce request, I haven't done any such withdrawals. In the same period, my cash withdrawals amount to a total of 200-300 dollars where my stbx did something like 4000 to 5000 dollars.

How long of a look back on these accounts are allowed ? Obviously my stbx planned this for a long time and acted methodically on it. I am wondering if I can show this unfair distribution from the community property and ask half of that money back as my fair share ? If yes, how long of a time am I allowed to go back on both sides and put the difference down.

$6,000 over 6 months in a marriage...it's not THAT much money. It can easily be claimed that it was normal day-to-day cash used by (or for the benefit) of both spouses...

You can ask for an accounting of the funds. They could have been used for an attorney or they could have been used for payment of household bills. Then again, she could have opened up an account in her name and deposited a cushion for herself. Tough to document that though. If you can, and it's proven to be dissipation of marital funds - well, then you can request your share of it.
