Spousal Support VA

OP will have to answer, but I'm guessing that it has to do with the fact that no-fault divorce in VA requires living apart for 1 year (or 6 months if there are kids). Maybe they had a final support order for the separation period and now that the year is up, want to get a divorce?
This was a follow up to an original post from a while back before the divorce questions were posted. The divorce in GA is a separate issue, therefore a separate post.

Virginia requires one year separation when divorce issues are contested. We never filed divorce in VA. The courts allow for support in cases where the spouse would be without means and reserves the right to rule the support final outside of a pending divorce. When a divorce is filed in VA, the spousal support order is incorporated.

At any rate, the support is permanently in VA and cannot be filed as a foreign judgement in any other State for future dismissal/reduction and this is supported by the Uniform Interstate Family Support Act.

I went through this same thing in Idaho and that court dismissed the case for reason of the UIFSA language.

What is the name of your state (only U.S. law)? Georgia

I filed my divorce petition in Gwinnett County, Georgia and I've been told I need to amend it to include an existing final spousal support order and a protective order issued in Virginia where we formerly lived.

I am doing this pro se due to lack of finances and I used a contested divorce format I got from the Legal Aid website.

Any advice on how to include this in the existing petition?
I'm not sure that GA has jurisdiction over stbx's pension. He apparently has never lived in GA and you seem to have been separated before you moved to GA.

Look, you have three states involved; ID, VA, and GA and actions going on all over the place. I really don't think you should go any further down this path until you've talked with an attorney.

Look up posts by 'signspinner' (and his various other names) to see what happens when you try to handle an interstate case on your own.
