I agree that it is slimy and she definitely shouldn't go after the nonexistent retirement money, but as far as perjury and criminal consequences, wouldn't that be a stretch. Everything that I have read on the subject indicates that criminal charges are very rarely brought about in regards to perjury in a civil case, especially family court. Perjury is rampant in family court matters, and they tend to like to keep the consequences in family court. Although it may be unjust, I think OP's ex is SOL because years have passed, and he didn't address the discrepancies is a timely matter.
