Affirmative Defense
I'm not a lawyer. I try not to even worry about that end of the whole process, but as you are bound and determined that I comment further on the legal aspects of this problem, this is my understanding:
If someone is giving an "affirmative defense" doesn't that mean that a charge has been filed and the person is defending himself or herself against that charge? I never said that the person would be convicted, just that someone could file a complaint and the boyfriend could be charged.
Lawyers and judges go to a lot of time, trouble and expense to do the work they do. I'm more than willing to let them. But, sometimes, a legal problem can be complicated enough to require the involvement of expert witnesses, arbitrators, and advocates. I enjoy that area of this field.
