Perhaps you can simply ask for a fee to "license" the work to them. Everything is negotiable ;)

I misspoke earlier and need to make a correction to what I wrote.

I said the musical group is (potentially) responsible for infringing on Matt's poetry and they are the ones who should be targeted with the cease and desist letter - and this is still true. However, it is also true that the record company can share in the liability for distributing copyright-infringed material, this even if they were unaware the material infringed.

Whatever the case, Matt needs to consult with an attorney for a review of all of the facts (including whether the band/recording company has registered a copyright in the lyrics, making them the presumed owners, and the dates involved in the creations of both the poem and the song).

I apologize for the error.

Zig's idea is good.

I have already suggested a license fee and settlement figure to them. Just waiting to hear something back from them. Even just an acknowledgement that they have read the letter would be nice at this point, at the moment im just waiting around with this whole situation just going through my mind constantly.

Hopefully the musical group will acknowledge their infringement of your work and do the honorable thing by compensating you for this use.


(edit to add: I just read through some of your poems, Matt. "Dare to Fly" is amazing! I also noticed that the YouTube version of the song containing your lyrics has been pulled......)

Just an update for you all.

I have been in talks with the bands manager and have agreed a settlement of 20% royalties, full credit and $3500 compensation.

Thank you all for all of the help and advice you have given me, it is very much appreciated.
