My daughter went to a Paintball place in Limerick, Pa and signed a liability waiver..
she stepped on a hornets nest and was stung
about 20x...my wife an RN removed the stingers..no hospital, but plenty of witnesses...is there a case here?

My response:

Where, exactly, was the hornet's nest? One problem that I see, right off the bat, is a question of damages. Your daughter never went to a hospital - - no records of treatment, quantity of stings, or pictures, or bills, or medical reports. Very difficult to prove damages without such information.

I move to make a motion to dismiss the possible case on the grounds that the potential plaintiffs claim is questionable. Notwithstanding the signed waiver of liability, it has not been fully established as to what type of insect exactly stung the child. First it is alleged that it was stinging bees yet potential plaintiff alleges hornets nest. Yellow jacket or straightjacket.

RN mother could testify as to the injuries sustained but opposing counsel could claim conflict of interest.

Yes, the main thing is that your daughter is alright. I have heard about cases where the person is allergic to the venom and is hospitalized or worse.
