I wouldn't wait to be served.

If EX is willing to testify to the existance of a non-existant loan, I suspect she is also willing to produce proof of service where none occured.

Call a lawyer today.
Fair enough

If you borrow $50 in cash one day from your dad and then on another give him $100 in cash do you still owe him?
Let's say I borrow $1,000 from my dad in April. I don't make any payments. Then, his birthday in November of that same year rolls around and I give him a birthday card with a $100 bill in it and a note saying "Happy Birthday!", do I still owe the $1,000?

Of course I do.

Speaking of records you might do well if you kept better tract of some of your statements in here. Some of your inconsistencies are rather glaring.
Don't forget these gems from his first post:

She claims that shortly before we got married that she lent me almost $40,000. She didn’t. The amount was around 1/5th of that.

1. There was no written contract. Or at least there was never an agreement that I signed. Originally there was going to be an agreement but I refused to sign it because she didn’t do her part.
That certainly indicates that there was a loan rather than a gift.
