Do the co's not contain a provision for notice to be sent in the event a party in unable to excercise visitation/parenting time?

Just an opinion - send another letter (certified) in regards to not receiving a reply concerning the surgery. Have your husband include in the letter that he will be returning the children to the mother's residence at such and such time and date as is necessary...

Not showing up w/out providing notice would not be a good decision in my opinion.

I would send the one certified and if no response send another thirty days before and still no response then send another informing her you will be taking the children with you and you will return them one day late. Good Luck

~Everyone has given you excellent advise, the same that I did in the first post. Who cares how long it takes, that is what mom will have to deal with for being so damn immature! Plus you will have the release form from the hospital with the date. 2 days of school missed will not harm the kids, but the trip may be a little boring. Will dad have other family there for him besides you? Hopefully, then between all of you, you could take turns getting the kids out of the hospital! Good Luck and keep us posted:)
