My experience is that the police do not always know how these procedures work. I've had them tell me to go to the prosecuting attorney's office to file something, and then when I get to the PA office they tell me it doesn't work that way. I suggest you go to the court house or wherever your domestic relations department is, and fill out the paperwork for the temporary order of protection. Have your mother explain why she is afraid of this man. Have your brother fill out one also. It may hold more weight since there are two people in the house that are afraid of him. They should both describe the harassment and any threats, even if they are vague. Also explain that he wants $15K to leave and that he turned down the $2K offer to leave. Attach a copy of the letter from the attorney as proof, if they will allow that. It should show how badly they want to be away from this loser. It never hurts to try. The judge may grant it and then your problem will be solved, assuming he respects the order. Hopefully he is afraid enough of getting arrested to respect it.

That is excellent advice. I'll tell my mom and brother today to take everything. Also, my mom is going to use the $2K to get a security system installed in her home plus $$ with camera's on the outside. This creep is the kind of guy that would come around at night and slash tires, and scratch cars. They are all insured, but I do not believe that if he did this once, it would stop. If anything, my mom will be safer from ANY creep.

I agree that this guy sounds like the type that would be capable of revenge. He is a parasite and thinks it's other's people duty to take care of him... At least that is how it seems to me. I know the type. It is called an antisocial personality. Prisons are full of them. I hope they get in front of a judge who can see the potential danger here. (Judges have seen all this stuff many times and I believe they are quick to figure out what is going on.) Good luck... Please post what happened.

Hi everyone.

We got the creeps stuff in a storage space, told management we would pay for one month. After that, it goes to auction if the creep doesn't claim it. Contacted creep, told him where is stuff was, he had 30 days to claim it from the storage manager. He spouted off that he was going to sue us and claim that his stuff was damaged, however, what he doesn't know was that before we handled the storage manager the key, we had him inspect the items that were in the storage to verify nothing was damaged. He didn't mind. The creep doesn't know we did this, and we don't think he'll do anything because he has $0.

That creep stole my mother's address book before he vacated and he is callling everyone mutliple times harrassing them, telling them we are all child molesters, drug dealers, animal abusers, etc. And that they need to turn us in, watch their backs. of course, he is just spouting off. Unless he leaves a message on a recorder or voicemail, cops won't do anything...SURPRISE!!!!!

My mom has a security system installation scheduled for early next week, and me and my husband have a friend who is a security manager at a large corporation that will help us to install wireless camera's around her property. We believe this creep may come around at night (the snake that he is) and vandalize cars and property. Not once but multiple times. Irrational behavior seems to be his style.

I would really like to get this guy in jail or deported back to Cuba, because I'm afraid for the next family he is going to put this through. My niece works for a company that can run get information on people and he's had over 20 residences listed, so we believe that terrorizing families is how he is surviving.

Hopefully, this will pass soon...I'm not too optomistic.....

So, he is out now? :D You still may need the order of protection to keep him away. I hope that he will just move on but hate the fact that he will only be bothering somebody else. Just keep a close watch on things. I'm glad the security system is being installed, but I still think it would be a good idea to get that temporary order of protection. I would also recommend that you take pictures of his belongings in addition to having the person at the storage place look at them. I doubt he will sue you though, since he doesn't really have any resources. He's probably just trying to scare you.

We went to try and get a RO, but it was denied due to lack of evidence...if you can believe that one. I took pictures of everything, before and after, and took a video of everything as wel. I believe we are covered there.

This guy has more rights than we do, apparently.....

Hopefully, this nightmare will go away.

FYI, When I found out that he was using my mom's address book, that gave me an idea. He left his phone behind and I took phone numbers off his phone before packing it and wrote them down. I believe his social worker may be on that list, and if there's a criminal need to track him down, hopefully one of these numbers will be the one to locate him.

Final Update.

It's been 1 week, since we moved the creep's stuff into a storage space. We think he ran out of gas, as far as harassing us, as he has no money, etc to fight with. My mom is getting her alarm installed today for peace of mind.

The creep did call my brother's work, my son's work, another brother in George, some of my mom's friends, saying we are bad people, etc. But all that seems to have subsided. My only thought is: I hope he isn't terrorizing another gullible old lady.

If he isn't bothering your mother or brother anymore, then he is probably:

1. dead
2. in jail
3. making somebody else miserable, or
4. kicking himself for not taking the $2K, if he is intelligent enough to realize he messed up.

CA CIVIL CODE:

1946.5. (a) The hiring of a room by a lodger on a periodic basis
within a dwelling unit occupied by the owner may be terminated by
either party giving written notice to the other of his or her
intention to terminate the hiring, at least as long before the
expiration of the term of the hiring as specified in Section 1946.
The notice shall be given in a manner prescribed in Section 1162 of
the Code of Civil Procedure or by certified or registered mail,
restricted delivery, to the other party, with a return receipt
requested.
(b) Upon expiration of the notice period provided in the notice of
termination given pursuant to subdivision (a), any right of the
lodger to remain in the dwelling unit or any part thereof is
terminated by operation of law. The lodger's removal from the
premises may thereafter be effected pursuant to the provisions of
Section 602.3 of the Penal Code or other applicable provisions of
law.
(c) As used in this section, "lodger" means a person contracting
with the owner of a dwelling unit for a room or room and board within
the dwelling unit personally occupied by the owner, where the owner
retains a right of access to all areas of the dwelling unit occupied
by the lodger and has overall control of the dwelling unit.
(d) This section applies only to owner-occupied dwellings where a
single lodger resides. Nothing in this section shall be construed to
determine or affect in any way the rights of persons residing as
lodgers in an owner-occupied dwelling where more than one lodger
resides.
