The money paid to counseling which are proximately related to a tort by the defendant will be compensable. Your time off work would not.

That's assuming there is a tort. But, if your damages are really 5K you might try a claim in small claims court. I suspect it will be removed to regular court and one of the defenses will be a qualified immunity.

Have you considered contacting the media? What with that video of the teacher beating a kid, I'm sure new outlets near you would love to have a local scandal, and perhaps an attorney will step up and help.

A teacher in elementary school punched my daughter (closed fist) 10-15 times on her back. My daughter was seated between two other students, at a table. She could not get away. This was during a play, where the teacher got carried away with her role. My daughter said "Stop that really hurts" at least 3 times, according to her and other students in the room. red marks were still visible an hour and a half later (the police saw them) and a bruise appeard a few days later. no assault charges can be filed (no proof of intent to cause harm). However, she is now in counseling due to nightmares and panic attacks that have happened since this incident. How do we find a lawyer to sue this teacher and the district?
"Intent" does not have to be proven. Assault is generally an UNwanted touching.

Striking a person 10 -15 times, especially a child is CLEARLY assault.

Now remember, (sarcasm), lawsuits are about money, NOT justice.

Qualified immunity is OFF the table here.

Contact the ACLU if an attorney will not take it.

Compensatory damages are not just out of pocket expenses.
