Hello,
I have posted this in the education law section but have received little input, so I wanted to ask here to see other peoples viewpoints. I know a fellow teacher who is 27 that is dating a student that is 16. She is not a student of his, they are not at the same school, and he does not even teach at a high school level. They have not had a sexual relationship according to them either. They are very much in love with one another, and her family is aware and supportive of the relationship. With this being said, apart from the moral or psychological implications which this could possibly contain, what is the legal standpoint? Is this illegal from a criminal or civil law point of view?
Second, if it is not illegal from a criminal or civil law point of view, could a school board dismiss the teacher from his position if this type of activity were not specifically spelled out in contract or local or state board policy? Thank you in advance for your help as they are asking me for advice.

Well one the this is a an adult having a relationship with a minor. And second the adult is a teacher, although not a teacher of this minor, but if this got out, yes this teacher could very well be fired and never be allowed to work in education again.

If I were you I would report this, before something real bad happens. Even if they are not having sex now, they could, and the last thing a 16 year needs, is a child on their hands. When they are still so much a child themsevles. And it doesn't matter if their parents aprove, it is still wrong and agaisnt the law.

Thank you for your response. I did have a further question however. I understand what you are saying regarding them possibly having sex while she is still a minor... However, IF they are not... then is any criminal law being broken? And if no criminal law is being broken, on what grounds could a school board dismiss a teacher unless it were explicitly stated in their contract? Again, thank you for your response.

It doesn't just include sex, anything shared between them such as heavey kissing, touching, caressing/petting of any of the body parts. Yes this teacher is breaking the law by being with this minor. If the school board found out or if anyone saw them together and felt that they were being a little too friendly together and reported it. The school board would very well fire the teacher, put it on this teacher record making it very hard for this teacher to ever work in education again.

Do yourself a favor and report it. It's wrong. Parents send their children to school believing they will be safe, protected and educated. How do you think parents would feel that their sending their child to a school where one of the teacher is having a relationship with a minor? How would you feel if it were your child?
