I was terminated from my place of employment on Friday. The reason given was that I lied on my application. Mind you I worked there part time since 2003 and went full time in 2005.
I was terminated from my previous employer and fought the termination through my union. I won my case at arbitration and was given a settlement. I resigned from that employer rather than go back and face any retribution. I resigned for personal reasons.
My current employer" learned" that I had allegations made against me at the last employer. On my application for employment I was asked if I had ever been disciplined, discharged or asked to resign from a prior position? I responded no believing that after winning my arbitration case that it was as if the discharge, discipline didn't occur.????
The other question asked was, Have you ever resigned from a prior position after a complaint had been received against you or your conduct was under investigation. Again I respond no, believing that winning at arbitration cleared this situation up.
My record was cleared.
Just a statement: If you go to arbitration to fight a termination and win what good does it do you if this situation arises and you are terminated from you next employer for things you were cleared of??? I believed wining at arbitration was a good thing? It sure doesn't appear that way today.
Thank you for your time and any insight you can provide me.

Winning at arbitration does not mean that the discharge never occurred. The correct answer would have been yes, with an explanation of the end result.
