"completely up to the judge who hears your case" but dont count on it. you choose to have a child with him, unless you get remarried and your new husband adopts the child, youre stuck with this man as your daughter's father untill she is 18. period.

For divorce. If you fullfilled residency requirements in Texas then file there and ask for sole custody. Don't ask for child support or anything just sole custody. If he does not show or respond you win by default and will get sole custody of the child.

Keep in mind he can always come back later and ask for visitation.
