What is the name of your state (only U.S. law)?
WA & OR
Grandma has custody in WA (CPS were involved - heroin use and neglect) of her two grandchildren; there is also an order of CS against Mom & Dad. Mom has a restraining order against Dad preventing him from being around Mom or the kids, but Mom & Dad are recently back together and live in OR.
CPS case-plan is through WA and neither parent has completed the case-plan according to the caseworker in WA.
Three weeks ago Mom called Grandma and told her that "her caseworker" in OR said she had completed the case plan and could come and get the kids back; Grandma has heard nothing from either CPS or the courts in WA and there has never been a hearing or any documentation but allowed Mom to take the kids to OR anyway.
Now Grandma is very concerned that she's been fed a pile of garbage since nothing has been changed through the courts and CPS still have the open case against both parents.
Mom is trying to get state aid for the kids in OR and has told Grandma that if she - Grandma - faxes a letter to Mom saying basically the kids now live with Mom that this is enough to transfer custody.
Grandma's questions:
1. I know I messed up but is it possible that this is right? Could my daughter be telling me the truth even without any court documents or anything?
2. I didn't know Dad was back on the scene - he just got out of jail. Can I force them to bring the kids back if I don't think they're safe? If they refuse is it kidnapping?
3. Is it possible for Oregon to tell my daughter "go get your kids" without anything happening here in WA?
