This question pertains to Criminal Negligence. I recently had an appt setup with a large Tire Chain to mount, balance and align my truck.

My vehicle never made it to the alignment. The mechanic, had accidentally put the wrong lug nuts onto my vehicle seizing them onto the thread of the bolts. My truck was in their care for hours. To get to the point, the manager was aware that the vehicle was not road ready and instead of finding a solution for my problem he rushed me out with no alignment, 3 lug nuts out of 16 on the rear end and told me to come back another day. I made it one block before i realized I couldn't make a left hand turn and the car began to throw off the driver side rear wheel violently. I very near missed two vehicles and ran my vehicle into the curb to help slow me down and stay straight like a bumper for children at a bowling alley. I am not hurt nor did I hurt anyone else, but this manager sent me away to take another customer with a higher priced service. He was told by the mechanic that the vehicle wasnt drivable and yet he we are. IS THIS CRIMINAL NEGLIGENCE? There is $6800 in damage and looking at some Yelp reviews to see if I could get some info on this manager, Ive found that this is something he has done regularly throughout 2018. Not to the extent of my situation but sending people, away when their problem is going to tie up a mechanics time for too long. I feel that this is corporates fault for pushing him to get the numbers up. Someone could most definitely be injured or killed with this gentleman making the decisions at this location. I have been going back n forth with the regional managers and they just backed out of paying for the repairs. I am taking them to court for sure on this but does the negligence play into the lawsuit in anyway? Thank you in advance.

You would be suing him for negligence and breach of contract. Forget criminal negligence. This is just a basic negligence and breach of contract claim. Negligence because he let the car go back to you in an unsafe condition and didn't warn you of it, and breach of contract because the shop didn't do the work you contracted them to do.
