I also recognized that the TRUE issue wasn't that the tow was requested, or even that the liable party wasn't the tow company.... I only offered my 'take' as a grin in light of the issue of the hundreds (thousands) of active TRAILER PARKS in California. And I say this as a 6th (or 7th) generation Californian (currently in Texas)!!

What about the old trailers in the cove off of PCH when you're coming from Newport Coast to Laguna Beach? The last one sold for $1.8 million last year. A reasonable price for a trailer.

The location; however, is unmatched.

I called the corporate office that owns the land today. I spoke to a lady there, Amy, and she said that the problem was with the towing company and not theirs. I stated to her that under section 22658 of the Vehicle Code that they have the right to tow a vehicle within the hour of being called. I talked to the tow company before specifically on this issue so I could be sure of the problem.

Now, I know that there is a code 798.34 that establishes the definition of a guest as 20 days of consecutive stay or 30 days in a calendar year. Since this is a new year, would these apply to me? Are there any regulations that say anything about visitors? I asked for the documentation and have been refused it by the manager. If there was no sign posted about visitors stay then is it illegal to tow because there is nothing posted?

Another thing. I looked at their signs yesterday, and there are a total of three signs. Two of the signs are the same size and are unfer the 17" by 22" regulated size that the vehicle code states. The other sign is about that size. I'm gonna measure them for sure.

I'm sorry I keep asking so many questions. I just want to be prepared so I can try to settle this out of court. I have to call the lady back on Monday after she talks to the manager, so I would appreciate some help before then.

I received a call from the corporate office today. Amy told me that I was in clear violation of the law and was no longer a guest of the park, meaning that I can not park in the visitor's parking.

She has letters from 3 tenants saying that I stay there often. Then she tried to argue with me about civil code 798.34 which states that" a) A homeowner shall not be charged a fee for a guest who does not stay with him or her for more than a total of 20 consecutive days or a total of 30 days in a calendar year. A person who is a guest, as described in this subdivision, shall not be required to register with the management."

Now she is saying that a calendar year is a 12 month period, but I thought that a calendar year is a year between the dates of Jan 1 and Dec 31. I have not stayed there a total of 30 days this year or stayed for 20 consecutive days. If I can argue that a calendar year is composed of the latter, can I sue for the charges?

She also said that the manager left a notice on my car friday night which then would of made it two notices. The thing is I was in Los Angeles friday night until I got home at 3 in the morning. I had to drop off my application to UCLA and then we watched a concert that night. So she is obviously lying on this matter. Then Amy hung up on me after I tried to read her the code.

I guess what I want to know is if I do indeed have a case on this. I'd hate to have to file and all just to learn that I can't do anything.

Please respond to this so I can start filing a suit if I can.
