It's VERY disturbing to have to keep pointing out what the boys fault in the collision is... but then again... it is what it is. Nobody is thinking about how my cousin feels... i mean, first off he has spent over 10 months as a murderer of two boys. he didn't have 3 clear signs that told him they were going to run that stop sign. As far as a conspiracy... with the witnesses... well if the shoe fits right? im just saying.. if I am his only voice then so be it. My soul wont let me rest until i get the whole story out. my cousin loves kids... he would NEVER INTENTIONALLY HURT them. and IF he thought or I thought he was to blame for their death ... my cousin would lay down and do his time like it was yesterday. Im not afraid to tell his story because I SPEAK THE TRUTH AND HAVE NOTHING TO HIDE... NOTHING... MY COUSIN HAS NOTHING TO HIDE... I HATE THAT I HAVE TO EVEN SPEAK OF THE BOYS... AT ALL.... BUT THEY SHOULD HAVE BEEN WEARING THEIR SEAT BELTS. GOD WHY WEREN'T THEY WEARING THEIR SEAT BELTS? AND WHY WHY WHY DIDN'T THEY JUST STOP? IF IF THEY WOULD HAVE JUST STOPPED THEY WOULD HAVE SEEN MY COUSIN COMING.... WHY DIDN'T THEY STOP?

You are distraught and need psychological help...period!

You are ranting against kids that were killed. We all get that it wasn't intentional. But, you are try to rationalize and make the dead kids the ones solely at fault.

Even with their seatbelts, they could have been killed. Even if they had stopped and misjudged the speed at which your family member was driving, could have been struck and killed. But the 'even ifs' don't matter. Two kids were killed. Period! Your cousin is not capable of not taking responsibility. He was driving too fast for the road, he was driving on a suspended/revoked license. He is in the wrong. Get some mental help for yourself--AND for your cousin.

As an aside: Was there a tox screen done on your cousin? Oh yeah--he fled the accident on foot. When was he found or did he turn himself in? What was his license suspended for in the first place? How young were the girls that were in the car with him?

Why, why, why did your cousin think it was ok to drive unlawfully? Why, why, why did he have to be speeding? Why, why, why didn't he abide by several laws that could have prevented the death of 2 kids and the injury to others?

you are cracking me up right now. wow. I think YOU need some psyco help... you are getting all worked up and you don't even know the case... sheeeesh.. it's okay. Just take a couple of breaths.. and try to think of something else to get under my skin.... cause you are WAY out of your league... bye bye MAN FUNNY HOW WHEN EVERYBODY SPEAKS OF THE OTHER DRIVER... IT'S A LOT OF "what if's" but because my cousin and his passengers lived and were not PROMINENT the "IF's " are a different story> funny how that works. One passenger was 18 the other was in her 30's if you MUST KNOW... lol careful now don't go getting your self all worked up. oh and yes he turned himself in... and yes they did do a tox on him... he was CLEAN... now what.

In one of the (many) articles out there, it is mentioned that evidence was presented to the matter that if your unlicensed relative had been driving the speed limit, there would have been no accident. He would have missed the other vehicle by 33 feet...

Yeah, I guess his speed didn't have anything to do with it :mad: <spit>

when my cousin was arrested at the hospital... he was only arrested on SUSPICION OF FELONY HIT AND RUN. THE JUDGE DISMISSED ALL HIT AND RUN CHARGES IN THE FIRST PRELIMINARY HEARING. BECAUSE IT WASN'T THE FLIGHT OR THE RUNNING THAT CAUSED THE INJURIES BUT THE CRASH ITSELF. WHEN THE JUDGE DISMISSED THE CHARGES THEY USED A PAST FELONY CHARGE THAT RESULTED IN PROBATION... NOT JAIL TIME IN ORDER TO BEAR A HEAVIER WEIGHT FOR HIS BAIL READJUSTMENT IN ORDER TO HOLD HIM.... THE FAMILIES MADE THREATS TO OUR FAMILY ... BLOOD FOR BLOOD. IT WAS AN ACCIDENT... AN ACCIDENT . THATS WHY THEY CALL THEM ACCIDENTS.

WHY HATE ON ME BECAUSE I AM DEFENDING FAMILY THAT DOESN'T DESERVE A MANSLAUGHTER CHARGE... WHEN THERE ARE MURDERERS THAT INTEND TO DO JUST THAT MURDER WHO NEED PEOPLES ATTENTION... THIS WAS AN ACCIDENT... AND HE DESERVES PRISON? COME ON. AGAIN I AM FORCED TO DEFEND MY COUSIN... SORRY. HIS RIGHT OF WAY WAS CROSSED... AND WE WILL PROVE IS WAS NO WAY GOING THAT FAST... AND THERE IS A DIFFERENCE BETWEEN 70 AND 90 MPH QUITE A DIFFERENCE.

Unfortunately, the conclusion reached by the collision report reaches a different conclusion. The PCF was assigned to the vehicle that ran the stop sign.

In collision investigation, the basic theory that governs the assignment of the PCF is what act - if removed from the situation - would have prevented the collision from occurring? In this case, it seems that the CHP decided (correctly so) that had the other vehicle NOT run the stop sign, the collision would not have occurred.

It is silly to try and argue that had the suspect been going the speed limit the vehicles would have missed by 33 feet because had the other vehicle stopped at the stop sign they would have also missed each other (though by, maybe, 25 feet or so).

The more I read, the more I am convinced the state's case is weak. But, they might be able to make the argument all the same.

I see this as a horrendous tragedy with dumb acts performed by all. This series of stupidity caused the death of two young people. The suspect in this will have to live with that guilt. If the state was smart they hit him with other charges in addition to manslaughter, because I don't know that they can make a case for manslaughter. Felony hit-and-run? Probably. Manslaughter? Doubtful.

I'll ask again:

What was his license suspended for in the first place? It does matter.

Do you have the actual audio of the initial 911 call/call to dispatch; or do you have the transcript? It probably has some information that might could help explain some things.

You would do better to stop trying to blame the dead kids--it's kind of like blaming a rape victim because she happens to work as a stripper. It is offensive.

Instead focus on the positive things about your cousin. Had the same job for 10 years? great ! Shows he's stable. Works as a volunteer? Shows he's compassionate
That should be part of his defense. Show his character as a "good person", not focusing on blaming the dead.
