Unattended vehicle hit on private property

What is the name of your state (only U.S. law)? Idaho
Three weeks ago my truck was struck by semi while parked at work.Driver admits fault. Have witnesses. Owner will not contact his claims dept. Same claims dept says I have to weight until policy holder contacts them before they can proceed. How long can this go on? Owner knows that claims is trying to contact him but is ignoring their calls.
