In PA, a BAC is not required to prove either underage drinking or public drunkeness. Intoxication can be proven without a BAC test......we all know the signs of someone being drunk. For the underage offense, it is unlawful for a minor to consume any alcohol, so the mere presence of any alcohol is sufficient to prove the violation.
The public is entitled to the police report with a few exceptions. However, not all departments would require an incident report be completed, so one may not exist. Regardless, there will most likely not be any BAC results as no test is required to be given.
