If you make enough money or have sufficient assets to pay for an attorney, you may not qualify for a public defender.

Still looking for advice. So, I had just recently spoke to two separate attorneys. One of the attorneys told me he's not too worried about the court and can probably reduce it down to an infraction. He also told me he doesn't feel it was a proper reason to stop me. The officer was parked at a gas station to my left when he heard the glass break. My passenger tossed it out the right window. It would be impossible for the officer to have seen the bottle coming outside my car. He even asked me, "Which one is going to get in trouble for throwing the bottle?" I responded with "Are you sure something was tossed outside my vehicle?" He said, "Are you calling me a liar?" He never admitted to seeing it. He obviously didn't see which window it was thrown out of. He didn't see if a hand was sticking outside the left window or right. He would know who threw the bottle if he was in clear visible contact. The attorney I spoke to would cost $2,000 to hire. If I fight the case with a public defender or even pleaded guilty, I believe the fines would be less than $2,000. My question is what is the point of hiring a personal attorney if I would be saving myself money by pleading guilty or fighting with a PD?
You really do not understand. It is extremely unlikely the police report
will reflect any of what you say. The reason for the stop will be well articulated. None of the conversation you had will be on the report.
It is your word against his. Also a breath test that indicates guilt.

The attorney gave you a statement based on your story only.
I can almost guarantee he will change his tune when he reads the
report.

Also, retaining clients is how he makes a living. He would not retain very
many if he said he could probably not do much. Right?

Maybe 2k is worth a reduction if he can get it. Although, maybe a p.d.
could work out the same plea. There is simply no way to tell. It good be
2k well spent or maybe a waste. Almost everyone in this situation goes
through the same dilemma.

Make a choice and stick with it. goodluck.

Your odds of having your charge reduced with a hired attorney is a lot more likely than with a PD and nil if you take a plea.

You'll save money if you go the PD route up front.. However, if you plead or are convicted, please factor in the fees for reinstating your license, recommended treatment and/or other CD requirements, hike in car insurance, probation fees, etc.

Not to mention consider that it's on your record until you decide to cough up the fee for expungement.

Just some things to consider in the long run.
