You need to work your way up at the police station.
I agree. Talk to that officer's supervisor and work your way all the way up to the police commissioner if you need to do so. Those people are legal strangers to your child and they have no right to keep him.

I will continue to work on moving up to someone higher. I tried last night during the welfare check and just wound up with a live pd camera in my face.

Do you believe the child is safe with the BF?

Why do you believe that or who told you that the court will not rule in your favor because mother is MIA and cannot be served?

Unfortunately it’s one of those cases, where all I know is what the mother has stated. The boyfriend and his family could be great people. But all I have is what I’ve been told by the mother and the fact he didn’t contact me when he has had my son for months makes it an extremely concerning situation. If I was to ever watch someone else’s kid for even a day I’d inform the legal guardian. So this info, is all I got to make a judgement off. It’s pretty much do you trust a stranger to watch your kid why the mother is mia.
Truthfully, I’m not sure where i heard that. I’ve made a +100 calls in the passed two days and spoken with a dozen attorneys trying to find one who is truly motivated to make this a priority. I could easily be mixed up about the emergency custody because for some reason hiring a pi was what a couple of them said first which may have been why I thought I needed to find the mother first.

unfortunately, it’s starting to look like this is correct. I have filed for emergency custody and they say it will be 3-4 weeks. Meeting with a new attorney Wednesday. I have confirmed there’s no way to get my son without a court order. Also confirmed the only way to get one is with the emergency hearing. I’m 23 year old college student. I’m withdrawing loans left and right. The new attorney is on a $3000 retainer and 250 an hr. It’s just money and idc it’s just upsetting that this is how poorly this system operates. I just want to get my son, figure out if the mother is okay, and give my son a good living environment. If I had my son, just for next couple weeks until court I’d feel okay about this and actually be able to sleep at night.
