Sure you can. However, it will specifically exclude incidents that occurred prior to the effective date of the policy. If it didn't work that way, none of us would buy insurance until we were sued. Plus, how much premium are you expecting the insurance company to charge based on the fact that there is an outstanding claim for $275k (if my memory is correct)? I'd charge about $325k for that policy.
