Well, if this was in the US I'd largely agree with this. But it's not. It's in the UK and the civil procedure rules there are different than in the US. For starters, they don't use subpoenas. They use summons to serve much the same function. (Summons are also used in the US in various circumstances.) The UK and many other countries are much more restrictive on the use of discovery than us litigating loving Americans so the procedures and what can be sought in the UK differ from what you'd do in the US.There's nothing you can SAY that will get them to release the video. They can release it when they get served with a subpoena. But to do that you would generally have to file a lawsuit against the employee and his airline before you can file the subpoena as part of the lawsuit.
